Initial Understanding
If we study the nature, it is observed that no individual human is endowed with perfect intelligence, basically nobody is free from deficiencies, Hence, it is not possible to take one individual’s or a particular group’s understanding to establish a stable societal system and if it is attempted and established it will not have longevity because of the inherent instability and this is the main reason for the lack of a practical and successful system. If we were to look at the history of Pakistan this fact is portrayed very clearly that the systems being installed were the works of a few individuals or powerful factions, serving their direct interests and the result of those efforts is before us today. We have also had one individual who tried to gather all powerful factions and achieved some kind of consensus on a system, which we know as the 1973 constitution. Although it was accepted under a united banner, the tragedy struck when the time came to implement it, it was the incompetence, greediness, and fear that spun the system into disarray; violating it before it could be established and made stable. This violation and destruction were also because of personality ‘worship’. The second reason for violation and destruction was the unclear wording which resulted in different interpretations. The third fundamental cause of violation and destruction was the concentration of power in one place. Fourthly, it was the incompetence of people put in charge of implementation. As well as the above-mentioned reasons the root cause was the aim or objective of the constitution. I will now try to explain in greater detail the above-mentioned causes to impart a clearer understanding.
Personality Dependence
IIf we delve into history just a little, we find that whenever constitution matters were written it was an effort by a few individuals and their foremost concerns were their own needs and benefits, in other words when those having the authority attempt to construct a system, obviously they would want to concentrate the power in that system to their own roles or posts so that they should not be held accountable. Hence if Law is applied to bring them to account, they would try to utilize the vested power to free themselves of any obligations of accountability under the Law. It is a fact that the Constitution lacks clear principles and contradicting laws which leads all constitution-related discussions of accountability leads to more confusion.
Usage Of Inexplicit Wordings
Just think for a moment we have a constitution which claims Urdu to be the national language and yet this very document of utmost national importance is written in English! This is a contradiction that makes a mockery of any serious intentions and integrity in solving national power structure problems, if this obvious simple fact is ignored then it makes one wonder what other problems are incorporated in this document. The wording used is foreign and it does not have clear explicit meanings, thus is open to many interpretations and thereby manipulations to suit different needs at different times. Further, the interpretation of this document has been handed to selected individuals of a faction of society, namely the Judiciary. You can call this ineptness or conspiracy; in any case, the results are clear for all to see. Firstly, you had the Judiciary offering all sorts of interpretations and due to media now a strange phenomenon has taken hold where everyone is doing it and condemning each other’s interpretations as incorrect. Thus, with the blessings of those who wrote it and those who interpreted it, today our constitution has become nothing but a joke. If you listen to any discussion on the Constitution, you will conclude that nothing seems to be right.
Analyzing these strange circumstances leads only to two conclusions which are that either the formulators had no in-depth understanding of the wording or that it was the result of a conspiracy to enable those people who are in authority to rule according to their own interpretations and to defy the power to another party to declare their interpretation as wrong and thus remain in power. A little pondering will show that this game has been happening right from inception and it is nothing new. As far as the Army is concerned, they have their guns which can be used at any stage to take over without much trouble. Where the constitution is unclear then control remains with the power whether it be wealth or grouping.
Concentration Of Authority In One Place
Authority is a trap that grips everyone because everyone holds a wish to have authority over others, however if free from cronyism, then the results depend on the intentions and ability of the person exercising the authority. In my view, we should now have a good understanding of our leaders, their intentions, and their competence. In Pakistan, the quarrels over authority and its division and distribution commenced from day one resulting in a variety of new and ever-changing constitutions. When we finished with the constitution, we delved ourselves into the thick jungles of amendments to it. You can label it as the incompetence of our leaders or you can label it as a conspiracy of a few leaders to keep power amongst them, either way, the results are clear for all to see. Just a little investigation will reveal that the fight amongst the title holders has always been about the allocation of concentration of authority within the system. Whether the authority remains with the President or the Prime Minister, it remains the same because it is an individual who has it. Both types of systems (Presidential and Parliamentary) are found in the world, and each is successful and disastrous. You will observe that the leaders are right at the front when talking about concentrating on authority but when discussions about the devaluation of authority, may it be the independence of provinces or local bodies, they show their true colors and oppose them.
Competence And Ability
There is no methodology established to assess the competence and ability of people in our system nor have any principles been established which could have helped in raising standards. We are suffering in every profession due to this fact and until we develop a comprehensive method to assess competence and ability in every field, progress is not possible. Until we establish principles, we cannot realistically hope to achieve a positive change. The Real Objective Of constitution Making According To History And Current Situation Of Pakistani Politics
If you investigate just a little into the making of our Constitution over the years you can easily reach the core intentions embedded in it. Just study any discussions and arguments on the constitution and you will see only one clear issue and that is the division of power over things. In our history to date all constitutions were made by those in power and their viewpoint is to continue holding on to power and rulership over the people and right from the beginning the purpose of our constitution has been rulership.
Have you not seen that in our country we have a system, and it is operating yet problems and issues of everyday living are not being resolved rather they are mounting heap upon heap? The straightforward answer is that this system was never created to solve problems but to rule. You can see it in front of you that elitists and rulers are continuing in splendor without any reduction of resources, instead, the number of rulers has substantially grown with each day passing. These elitist rulers never experience any problems in satisfying any of their needs from within the same suffering society.
It is a feature of life that when a person holding power makes any laws, by nature he would want or be tempted to keep himself above those laws; this is the same all over the world. If you study systems all over the world, you will see that elitists and rulers seem to be favored by the laws as stated, but despite this reality, some systems still look after the needs of the ordinary citizens and obviously, others are not like our system which is only looking after rulership. In my humble opinion, the root cause of this difference in the systems is the intentions and ability of the ruler.
In my view, if the principles and laws were made by involving all individuals of society then that would be an exemplary system. Let us get together now to make a constitution (principles and laws) for our own political party or organization before entering the race to get power. I am confident that we can set up a practical system that utilizes rulership to attain solutions to our problems.
